ไอลอว์ ยืนยัน พ.ร.บ.ประชามติฯ มาตรา 61 ขัดหลักเสรีภาพ ขอทุกฝ่ายเปิดให้ประชาชนรณรงค์ได้

เนื่องจากขณะนี้เรายังไม่ทราบเหตุผลที่แท้จริงในคำวินิจฉัยของตุลาการศาลรัฐธรรมนูญทั้ง 9 คน ในประเด็นนี้ เราทราบเพียงผลคำวินิจฉัยจากข่าวประชาสัมพันธ์ของสำนักงานศาลรัฐธรรมนูญเท่านั้นว่า ศาลรัฐธรรมนูญมีมติเอกฉันท์ พ.ร.บ.ประชามติฯ มาตรา 61 วรรคสอง ไม่ขัดต่อรัฐธรรมนูญ ฉบับชั่วคราว ปี 2557 
ไอลอว์ขอยืนยันตามที่ได้ยื่นคำร้องไปแล้วว่า พ.ร.บ.ประชามติฯ มาตรา 61 วรรคสอง ซึ่งบัญญัติห้ามการแสดงความคิดเห็นเกี่ยวกับร่างรัฐธรรมนูญและการทำประชามติที่ผิดไปจากข้อเท็จจริง หรือมีลักษณะรุนแรง ก้าวร้าว หยาบคาย ปลุกระดม หรือข่มขู่ โดยมีอัตราโทษจำคุกสูงถึง 10 ปีนั้น เป็นกฎหมายที่ขัดต่อหลักเสรีภาพการแสดงออกซึ่งเป็นหลักการที่อยู่คู่กับการเมืองการปกครองไทยมาทุกยุคสมัยและเป็นหลักการพื้นฐานที่มนุษยชาติยอมรับกันโดยทั่วไป 
การที่มาตรา 61 วรรคสอง บัญญัติถึงการกระทำอันเป็นความผิดโดยใช้ถ้อยคำที่กว้างและคลุมเครือ เช่น คำว่า "รุนแรง" "ก้าวร้าว" "ปลุกระดม" ซึ่งเป็นคำที่ไม่เคยมีนิยามอยู่ในกฎหมายฉบับใดมาก่อน ทำให้ประชาชนไม่สามารถเข้าใจได้ว่าการแสดงออกอย่างใดจะผิดกฎหมายหรือไม่ ขัดต่อหลักการของกฎหมายอาญาที่ต้องชัดเจนแน่นอน ส่วนการแสดงออกด้วยถ้อยคำที่ "หยาบคาย" นั้น ตามปกติแล้วแม้จะเป็นสิ่งที่ไม่สมควร แต่ก็ไม่ใช่การกระทำที่ต้องมีโทษทางกฎหมาย ขณะที่บทกำหนดโทษของความผิดตามมาตรา 61 วรรคสอง ก็เป็นโทษที่รุนแรงเกินไป ไม่ได้สัดส่วนกับการกระทำที่เป็นเพียงแค่การแสดงออกซึ่งความคิดเห็นโดยสงบ อัตราโทษจำคุกไม่เกิน 10 ปีนั้น เทียบได้กับความผิดฐานฆ่าคนตายโดยประมาท หรือฐานทำให้หญิงแท้งลูกและถึงแก่ความตาย การบัญญัติมาตรา 61 วรรคสองเช่นนี้ จึงเป็นการจำกัดสิทธิเสรีภาพของประชาชนเกินขอบเขต โดยไม่มีเหตุอันสมควร
เราเห็นว่า บรรยากาศการพูดคุยเรื่องร่างรัฐธรรมนูญ และการทำประชามติทุกวันนี้เป็นไปอย่างเงียบเหงาผิดปกติ ทั้งที่ใกล้ถึงเวลาลงประชามติแล้ว โดยที่ประชาชนที่มีความคิดเห็นทั้งเห็นด้วยและไม่เห้นด้วยต่างไม่กล้าแสดงออก ถกเถียง หรือทำกิจกรรม ดังที่มีตัวอย่าง การจับกุมดำเนินคดีกับนักกิจกรรมที่แจกเอกสารแสดงเหตุผลไม่เห็นด้วยกับร่างรัฐธรรมนูญ และมีผู้ถูกคุมขังอยู่อย่างน้อย 7 คนในปัจจุบัน บรรยากาศเช่นนี้ย่อมไม่ส่งผลดีต่อการทำประชามติที่จะเกิดขึ้นในวันที่ 7 สิงหาคม 2559 และมีแต่จะทำให้ผลการลงประชามติไม่เป็นที่ยอมรับทั้งโดยประชาชนชาวไทยและประชาคมโลก
เราไม่มีความประสงค์จะสร้างความไม่สงบเรียบร้อยในการทำประชามติ และไม่ต้องการให้เกิดความขัดแย้งทางการเมืองจนนำไปสู่ความรุนแรง แต่เรายืนยันที่จะทำกิจกรรมทางสังคมและใช้ช่องทางตามกฎหมายทุกวิถีทางที่มีอยู่ต่อไป เพื่อเปิดโอกาสให้ประชาชนสามารถแสดงความคิดเห็นเกี่ยวกับร่างรัฐธรรมนูญและการจัดทำประชามติได้อย่างเสรี เพื่อให้การจัดทำประชามติที่จะเกิดขึ้นสามารถสะท้อนเจตจำนงของประชาชนได้อย่างแท้จริง
ในระหว่างที่พ.ร.บ.ประชามติฯ มาตรา 61 ยังไม่ถูกยกเลิกโดยศาลรัฐธรรมนูญ ก็ยังเป็นไปได้ที่บรรยากาศการทำประชามติจะดีขึ้น หากหน่วยงานที่เกี่ยวข้อง ทั้ง คสช. และ กกต. เปิดให้ประชาชนได้แสดงความคิดเห็นและทำกิจกรรมรณรงค์ได้อย่างเต็มที่ ไม่บังคับใช้กฎหมายที่ไม่มีความชอบธรรม ยกเลิกการปิดกั้นการแสดงความคิดเห็นทุกรูปแบบ เลิกจับกุมประชาชนจากการแสดงความคิดเห็น ปล่อยตัวผู้ถูกคุมขังและยุติการดำเนินคดีที่กำลังเกิดขึ้นด้วย
iLaw maintains that Section 61 of the Referendum Act conflicts with the right to express opinions. We ask that the barriers to public campaigning be removed.
Although the Constitutional Court has arrived at a unanimous verdict that Section 61 Paragraph 2 of the Referendum Act does not conflict with the Temporary Constitution of 2014, we do not yet know the reasons of the nine judges for coming to this verdict.
Section 61, paragraph 2 of the Referendum Act prohibits any comment or expression of opinion about the Draft Constitution or the referendum that "deviates from the truth" or is of an "abusive", "aggressive", "profane", "seditious", or "threatening" nature intended to influence voters to vote one way or another, or to abstain from voting. This offence carries a prison sentence of up to ten years. iLaw reiterates, as stated in our petition to the Ombudsman, that Section 61, paragraph 2 violates the principles of freedom of expression that have prevailed under successive Thai constitutions and which are an integral part of international agreements to which Thailand is a signatory.
The fact is that Section 61, paragraph 2 describes the offence in such broad and vague terms as "abusive", "aggressive", and "seditious", that have never been defined under any law. The use of "profanities", though not considered desirable, has never been grounds for punishment under the law. At the same time, the punishment for offenders is extreme, and completely unjustified for peaceful expressions of opinion. Prison sentences of up to ten years apply to such offences as manslaughter, or for carrying out an illegal abortion resulting in the death of the mother. Therefore Section 61, paragraph 2 is an unjustified and excessive restriction on freedom of expression.
We have observed that public discussions on the Draft Constitution and on the Referendum are unusually muted, even though day of the Referendum is rapidly approaching. People are afraid to speak out, or to take part in debates, or to carry out campaign activities. This is because there have been a number of arrests of activists for distributing leaflets urging voters to reject the Draft Constitution, and at least seven people are still in detention at the present time. This atmosphere is not conducive to a free and fair referendum, and therefore the results are unlikely to be fully accepted, either in Thailand or abroad.  
We do not wish to see unrest relating to the Referendum, nor political conflicts which lead to violence, but we are determined to carry out social activities and make use of all legal avenues available to us to open up opportunities for the public to express their views on the Draft Constitution and to participate in a free referendum which accurately reflects the wishes of the population.
Even while Section 61, paragraph 2 of the Referendum Act remains in force, there are still opportunities to improve the situation surrounding the Referendum. This would depend on the willingness of the Election Commission and the Government to declare the lifting of restrictions on all forms of peaceful expression relating to the Referendum, and an end to all related arrests, as well as the release of all detainees, and the termination of all relevant criminal proceedings.
