Saard Chandee, an ex-columnist of Ban Muang newspaper and an ex-director of People Channel News website, posted 12 articles on website, WWW.PCHANNEL.ORG. This articles are deemed to defame Chermsak Pinthong, an ex-appointed senate, and associates that were causes and intended to draft the 2007 Constitution for eliminate the Royal Institution. The articles were not fact and made reader misunderstood Chermsak.
The Court of First Instant sentenced Saard, the defendant, to 11 years in jail since his confession was benefit for the court decision. So the court halved the jail term sentences to 5 years and 6 months without suspended sentence. By The court gave reasons that the defendant made up the story implicated with the Royal Institution that Thai people extremely showed the respect. This made most people hated Chermsak. Moreover, the defendant did not verify the information before published. There is no reason for suspending the sentence.
