Sumet was excited around 100 people to gathering in front of Fortune Town mall to against the coup. He was arrested while walking in that mall and was detained at the Crime Suppression Devision for 7 days. He was charged with defying the NCPO order No.7/2014. Sumet has been alleged that on 1 June 2014 around 2.30 PM he had stimulated approximately 100 people to gather in front of the Fortune Town Mall on  Ratchadapisek road to anti the coup d'etat. The military requested for reinforcement from the police at Huai Khwang police station to negotiate with the protestors to stop gathering, but, they still continued gathering to anti the coup d'etat. Until 3.00 PM, the military requested the protestors again to stop gathering but no stopping, so the military gave a warning. The warning made the protestors intensify their action by making clamor, showing three fingers which is the symbol of anti-the coup d'etat. After considering that the situation would be worse, the military then captured the people who violated the NCPO’s order prohibiting political rally, and brought them into detention at the crime suppression division. 
 
According to the survey, we found that, there was no news report about the gathering of around hundred people at the Fortune Town Mall on that day. Meanwhile, a friend of the accused reported that the accused went to Terminal 21 on Sunday 1 June and only took the photo showing his three fingers. And as well, he posted in the facebook saying that “Bye bye Terminal 21! It’s better to go to Fortune…” After that, he took the MRT to Fortune Town Mall and was arrested there.      
 

Circumstance of Arrest

Sumet said that he took his photo showing three fingers while he was walking inside the Fortune Town Mall, but he did not show as high as the protestors did. Then the plainclothes policemen arrested him and took him into the car. During taking him into the car, they locked his body and put the blindfold on his eyes. Inside the car, Sumet asked them to put the blindfold off because he did not think about fleeing. Then, they put it off and sent him to the crime suppression division.

On 4 June 2014, the inquiry officer of the crime suppression division submitted the request to put Sumet into the temporary detention at the military court Bangkok, and oppose the bail. The Court rejected the request for bail asserting the reason that “considering on the circumstance of the case, in the request asking for temporary detention, the inquiry officer specified the reasons for opposing the temporary release of the accused as the accused was the one who stimulated and incited the people to gather. In case there is a reliable causes that the accused may create any other dangers or any damages on the operation of inquiry officer on investigation after the release. The temporary release is not permitted.” Sumet then was detained in the Bangkok Remand Prison.   
 
On 10 June 2014, Sumet submitted a request for bail again. This time the military court allowed him to be temporally released on bail with 40,000 baht cash as a guarantee.
