Suwicha was arrested by DSI. He refused all charges; however, he was detained at the Criminal Court without his chance to seek a lawyer. After the arrest, his company filed him stated that he would not receive any compensation since he destroy the company reputation.
26 January 2009
After a period of the committal, his lawyer appealed but the court denied the request. This was the second try since the first failed on 23 January when the lawyer did not present enough documents.

The lawyer submitted the third bail request while the court denied the request on 4 February 2009.

The prosecutor filed the case to the court. Suwicha pledged guilty at the court.
3 April 2009
The court found guilty in to 2 counts and sentenced Suwicha to 20 years. The sentence was reduced in half as the defendant confessed. Later, the royal pardon was granted.
28 June 2010
Suwicha received the royal pardon and was released. He traveled to Siriraj Hospital to sign on a signature willing the king a good health on the next day then matriculated for one year.
